1. Scope
These Terms of Service govern your access to and use of Quldra applications, APIs, websites, and related services operated by Funktsioon OÜ.
2. Eligibility and legal compliance
You may use Quldra only where use of encrypted communications tools is lawful. You are responsible for compliance with local law, sanctions, export controls, telecommunications rules, and data-protection requirements.
3. Accounts, installs, and credentials
- You are responsible for your install identifiers, recovery materials, devices, and any passcodes/biometric unlock controls you enable.
- You must provide accurate information when reserving usernames or adding contact/billing information.
- You are responsible for activity from your account/install unless caused by our breach of these Terms.
4. Acceptable use
You may not use Quldra to violate law or harm others. Prohibited conduct includes fraud, harassment, threats, malware distribution, unauthorized access, abuse of invite/join systems, payment abuse, and attempts to bypass, disable, or probe security controls without authorization.
5. Messaging, groups, and moderation
- Group creators/admins are responsible for membership and invite controls in their groups.
- You may submit moderation reports for suspected abuse. We may investigate and act on reports.
- We may remove content, limit features, or suspend access to protect users, comply with law, or maintain service integrity.
6. Security
Quldra applies security controls intended to protect user data and service integrity. No system is perfectly secure, and you remain responsible for endpoint security, device hygiene, and credential protection.
Quldra uses end-to-end encryption, meaning messages are encrypted and decrypted on-device using keys that are specific to that device. Encryption keys are not transferred during account recovery. As a result, message history from a previous device cannot be viewed or recovered on a new device.
7. Billing, subscriptions, and purchases
The Starter Monthly subscription ($2.99/month) automatically renews each billing cycle until cancelled. Payment is charged to your platform account at confirmation of purchase. To avoid being charged for the next period, cancel at least 24 hours before the end of the current billing cycle. You can manage or cancel your subscription at any time through your device's store subscription settings. Refunds are handled by the store where you purchased, in accordance with its refund policy.
- All billing, quotas, subscriptions, and purchased bandwidth are tied to your installation and device. Recovering your account on a new device resets your billing state: active subscriptions are revoked and any remaining Pay-As-You-Go credits are forfeited. You will need to purchase a new subscription or bandwidth credits on the new device. Only one device may be active per account at any time.
- Each new installation receives a one-time complimentary bandwidth allowance (currently 100 MB). This allowance does not reset or renew and is consumed on a lifetime basis. Once exhausted, a subscription or Pay-As-You-Go purchase is required to continue sending messages.
- Quldra may offer quota/token-based usage, subscriptions, and one-time top-ups.
- Pay-As-You-Go (PAYG) bandwidth credits expire twelve (12) months from the date of purchase or redemption. Each new purchase or coupon redemption extends the expiration of all accumulated PAYG credits to twelve months from that date. Expired PAYG credits are forfeited and cannot be recovered.
- Monthly subscription bandwidth allowances reset at the beginning of each calendar month (UTC) and do not roll over to subsequent months.
- In-app purchases are processed by the applicable platform store under its own terms.
- We may validate receipt/transaction data before granting subscription status or byte credits.
- Taxes, currency conversion, and store fees may apply based on your jurisdiction and payment method.
8. Service availability and changes
We may modify, improve, or discontinue features at any time. We do not guarantee uninterrupted availability, specific delivery times, or permanent retention of any message, media object, or metadata.
9. Intellectual property
All rights, title, and interest in Quldra and related software, branding, and content are owned by Funktsioon OÜ or its licensors, except for content you submit.
10. Suspension and termination
We may suspend or terminate access for Terms violations, legal or sanctions risk, abuse, security threats, non-payment, or operational necessity. Where reasonable, we will provide notice.
11. Disclaimers
To the maximum extent permitted by law, Quldra is provided on an "as is" and "as available" basis, without warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be error-free or fully secure in all threat models.
12. Limitation of liability
To the maximum extent permitted by law, Funktsioon OÜ is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business opportunity. Our aggregate liability is limited to the amount you paid to us for Quldra in the 12 months before the event giving rise to liability.
13. Governing law
These Terms are governed by the law specified in your commercial agreement with Funktsioon OÜ (or, if no agreement exists, by applicable law determined by conflict-of-law rules), subject to mandatory consumer protections.
14. Changes to these Terms
We may update these Terms from time to time. Continued use after an updated effective date constitutes acceptance of the updated Terms.
